Eyes2search maximum aggregate liability hereunder whether for breach of this Agreement or otherwise and whether or not arising from the negligence of Eyes2search or any other person involved directly or indirectly in the provision of the Services shall not exceed an amount equal to the Charges (exclusive of VAT) payable to Eyes2search hereunder in respect of the particular mailing the subject of such breach or other claim
The provisions of sub-clauses above shall not apply to any liability in respect of death or personal injury arising out of the negligence of Eyes2search its servants or agents
The Client hereby expressly agrees that time shall not be of the essence in relation to Eyes2search obligations under this Agreement and that upon leaving the premises of Eyes2search the Media shall be at the risk of the Client
Limitation of Liability This site is provided on an as is basis. Given the complexity and vulnerability of the use of the Web and the travel industry, we do not guarantee the accuracy nor the availability or timeliness and completeness of this site or that it is not infected by viruses.
